These Terms of Service ("Terms") govern your access to and use of the Flat Earth mobile application ("App"), the Flat Earth Bluetooth leveling sensor ("Device"), and the website pinestatebrands.com ("Site"), operated by Pine State Brands ("we," "us," or "our"). By accessing or using our App, Device, or Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our products or services.
You may use our App, Device, and Site only in compliance with these Terms and all applicable laws and regulations. You agree not to misuse our services or help anyone else do so. You must be at least 13 years old to use our App.
The Flat Earth leveling system is designed to assist with leveling RVs, trailers, and campers. While we strive for accuracy, the Device and App provide measurements as a reference tool only. You are responsible for verifying that your vehicle is properly and safely leveled. Pine State Brands is not liable for any damage, injury, or loss resulting from reliance on leveling data provided by the Device or App.
Some features of the App may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
All content, features, and functionality of the App, Device firmware, and Site — including but not limited to text, graphics, logos, icons, images, audio, video, software, and code — are the exclusive property of Pine State Brands or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App or Site without our prior written consent.
You agree not to use the App, Device, or Site:
The Flat Earth Device is covered by a limited manufacturer's warranty as described in the product documentation included with the Device. The App and Site are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App or Site will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. We do not warrant the accuracy of leveling measurements under all conditions.
To the maximum extent permitted by law, Pine State Brands shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, or for any property damage or personal injury resulting from your access to or use of (or inability to access or use) the App, Device, or Site.
You agree to indemnify, defend, and hold harmless Pine State Brands and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the App, Device, or Site, or your violation of these Terms.
You may request the deletion of your account and associated data at any time by contacting us at contact@pinestatebrands.com. Upon receiving your request, we will delete your account and personal data within 30 days, except for any information we are required to retain by law.
Our App and Site may contain links to third-party websites or services. We do not control and are not responsible for the content, privacy policies, or practices of any third-party websites or services.
We may terminate or suspend your access to the App or Site immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App and Site will immediately cease.
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our products after those revisions become effective, you agree to be bound by the revised Terms.
